Analysis of recent Ethereum events: Will ETH be considered a security?

1. Hong Kong Virtual Asset Spot ETF was listed on the Hong Kong Stock Exchange on April 30, with a first-day trading volume of HK$87.58 million. Although the trading data was not ideal, it opened the door to alternative assets for Hong Kong investors.
2. US asset management company Franklin Templeton listed its spot Ethereum ETF on the website of the Depository Trust and Clearing Corporation (DTCC), but the probability of SEC approval is about 35%, and SEC Chairman Gary Gensler's position that ETH may be identified as a security has increased the complexity of the decision-making process.
3. Court litigation documents filed by ConsenSys show that SEC Chairman Gary Gensler began trying to treat Ethereum as an unregistered security at least a year ago, and ConsenSys is questioning the SEC's attempts through litigation.
4. Historically, the SEC's position on Ethereum has been relatively clear: Ethereum is not a security. But after Gary Gensler took office, the agency's position on Ethereum has subtly changed.
5. Industry insiders believe that the SEC’s attempt to classify ETH as a security is a strategic move aimed at gaining regulatory authority over ETH and other suspected security tokens, which may have a huge impact on the entire crypto asset industry.
