Democrats plan to continue pushing the CLARITY Act, which would grant the SEC greater regulatory authority and restrict Trump's crypto activities.
November 5 — Crypto reporter Eleanor Terrett posted a scoop on social media, citing three industry sources who spoke with Democratic staffers, that House Democrats are discussing a plan aimed at expanding the "Crypto Investor and Consumer Protection Act" (the amendment introduced by Representative Maxine Waters in 2025 to the CLARITY Act) into a broader crypto "market structure" bill in the next Congress.
The proposal would incorporate the provisions of the Democratic CLARITY Act that Waters originally introduced in the House (but which did not pass), as well as provisions that Senate Democrats agreed upon with Republicans ahead of the September cloture vote.
Some of the proposals currently under discussion reportedly include: giving the U.S. Securities and Exchange Commission (SEC) a greater role in overseeing the crypto market, while the role of the U.S. Commodity Futures Trading Commission (CFTC) would be relatively limited. In addition, further ethics provisions will most likely be proposed to restrict crypto activities by President Trump and other federal officials.
In response, Republicans have labeled the proposal a "messaging bill" (meaning a bill intended merely to convey a political stance and lacking realistic prospects of becoming law).
