Can Trump's $100,000-priced early access service be banned under Democratic control?

According to monitoring by PolyBeats, the Truth API offered by Truth Social's parent company starting August 1 indicates that subscribers can see Trump's posts approximately 50 milliseconds earlier than regular users. The service costs $60,000 to $100,000 per month, has signed over 10 clients, mainly high-frequency trading firms.

On the prediction market Polymarket, the probability of "a court halting Trump's Truth Social early access program within this year" is 14.5%.

Mr-Krabs bought $1.6k on "No," having participated in 820 market trades in total, with a 78% win rate, 92.8% one-sided trading frequency, PnL +$46.5k, ROI +1.0%.

The Intercept and the Freedom of the Press Foundation sued Trump and White House-related officials on August 12 in the Southern District Court of New York. The complaint alleges that Trump frequently uses Truth Social to post information on tariffs, diplomacy, and military affairs that could affect markets, and the paid interface divides this information into two tiers of access, violating the First Amendment's principle of equal access and the Fifth Amendment's restriction on unreasonable fees.

Trump Media stated that selling platform data interfaces is standard practice in the tech industry, and posts are still published to all users, with only the machine interface being a few milliseconds faster. The White House stated that pricing is a private business decision of the company, not made by the President himself.

On October 28, Reuters reported, citing informed sources, that Bloomberg, Susquehanna International Group, and Jump Trading have purchased this service. All three companies declined to comment. Trump Media acknowledged industry demand for the interface but said the report came from anonymous sources and emphasized its commitment to client confidentiality.
