Clarity Act to Expire January 3, 2027 If It Fails to Secure 60 Senate Votes
Nov. 5: According to Bitcoin.com, Democrats have won control of both the House and Senate in the midterm elections, a shift expected to reshape legislative priorities with greater emphasis on strict regulation of emerging technologies. Industry advocacy group The Digital Chamber said the current version of the Clarity Act will expire when the 119th Congress ends on January 3, 2027, and any push in the next Congress would require resubmitting the bill and negotiating a new agreement. Because passing legislation in the Senate typically requires 60 votes, Democrats, despite holding the majority, still need to win Republican support to advance crypto market structure legislation.
The report said market analysts expect a restarted bill under Democratic control to include stricter compliance standards, stronger consumer protections and tighter DeFi regulation. Crypto critic and Senator Elizabeth Warren is expected to chair the Senate Banking Committee, and The Digital Chamber expects regulation to shift quickly toward stricter oversight of digital asset exchanges and their integration into the banking system, while the House Financial Services Committee may move toward enforcing strict stablecoin reserve requirements, expanding consumer disclosures and strengthening anti-money laundering controls. In addition, the new Congress is expected to place greater emphasis on AI-related data privacy and national security safeguards.
