CFTC Plans to Independently Advance Crypto Regulatory Framework Without Legislative Authorization
On October 6, according to Cointelegraph, that Michael Selig, Chair of the U.S. Commodity Futures Trading Commission (CFTC), stated the agency will follow President Donald Trump's directive to continue advancing a cryptocurrency regulatory framework without new legislative support from Congress. Previously, the CLARITY Act, which was highly anticipated and aimed to grant the CFTC expanded authority, failed to pass in the U.S. Senate.
Selig revealed at the Fordham Law Blockchain Regulatory Symposium that the CFTC has issued an advance notice of proposed rulemaking targeting firms that allow retail clients to trade crypto assets on margin, with leverage, or through financing, a plan dubbed "CTX". Additionally, regulators plan to establish a new designated contract market category called "Crypto Asset Markets" (CAM), allowing eligible exchanges to opt for registration and operation under this framework.
David Tawil of ProChain Capital noted that opponents of the CLARITY Act did not anticipate the executive branch taking action in the absence of legislative constraints. With SEC Commissioner Hester Peirce stepping down, the SEC currently has only two remaining commissioners; meanwhile, Selig stands as the sole commissioner and chair of the CFTC, driving this shift in regulatory strategy.
