Lawyer: Stablecoin businesses under the GENIUS Act cannot be subject to a one-size-fits-all approach; companies should ensure compliance in advance based on their specific business
On October 21, according to Bitcoin.com, Kelman Law attorney Michael Handelsman stated that the GENIUS Act has changed compliance planning for companies issuing, distributing, and using stablecoins. The bill was signed on July 18, 2025, with the U.S. Treasury anticipating its overall effective date to be January 18, 2027, while restrictions on digital asset service providers providing or selling payment stablecoins to Americans will take effect starting July 18, 2028. The article emphasizes that the latter date does not mean companies can defer assessing existing legal obligations.
Implementation details of the bill are still underway: the OCC released a major proposed rule in February 2026, the Federal Reserve published a proposal on September 24 covering regulated issuers, reserves, capital, and custody, and an interim final rule for state regulatory regime certification took effect on September 30.
