France Proposes 31.4% Tax on Stablecoins as Russian Central Bank Sets P2P Endgame

On October 16, 2026, according to Coin Bureau market reports and CoinMarketCap policy disclosures, the cryptocurrency regulatory systems in Europe and the Eurasian region are simultaneously signaling structural tightening, with both anchoring key policy implementations to 2027. During budget deliberations in the French National Assembly, a tax reform amendment was proposed to classify exchanges for electronic money tokens (EMT stablecoins) compliant with EU MiCA regulations as taxable asset disposals, applying the default capital gains rate of 31.4%; meanwhile, the Central Bank of Russia announced that direct peer-to-peer (P2P) cryptocurrency transactions between individuals will only be permitted until July 1, 2027, after which all transfers must flow exclusively through authorized intermediaries. These two legislative developments collectively mark how the two gray areas of on-chain tax-avoidance havens and over-the-counter unregulated clearing channels are undergoing systematic consolidation at the sovereign level.

Setbacks for On-Chain Havens and France’s 31.4% Stablecoin Tax Bill

In the tax practices of major global jurisdictions historically, cryptocurrency-to-cryptocurrency swaps typically enjoy tax deferral treatment. Current French tax law follows this logic: when investors on-chain swap Bitcoin or Ethereum into stablecoins like Tether (USDT) or USD Coin (USDC) to hedge risk, as long as funds are not withdrawn to bank accounts to exchange for fiat currency, they are not counted as capital gains.

The budget amendment currently under review in France seeks to break this long-standing industry tacit agreement. The proposal legally equates electronic money tokens (EMTs) compliant with the EU MiCA regulatory framework with sovereign fiat currencies, stipulating that starting January 1, 2027, any action swapping unrealized crypto assets for regulated stablecoins will immediately trigger tax liability. This means investors will face a 31.4% tax bill even if they only complete hedging within a non-custodial wallet and the assets never enter traditional financial institutions. Earlier in the budget deliberations, this provision encountered procedural hurdles, and a plenary session of the National Assembly is expected to resume debates on the complete budget text before October 20.

Russia’s Compliance Noose on Eliminating Direct Individual P2P Transactions

Unlike Western Europe’s encroachment at the tax base level, the Russian Central Bank’s regulation of crypto transaction formats directly targets underlying liquidity channels. The latest plan disclosed by the Russian Central Bank explicitly sets a transition period cap, stating that direct over-the-counter peer-to-peer (P2P) transactions between individuals can only operate legally until July 1, 2027.

Since being subjected to external financial sanctions, unmediated direct P2P networks have formed a crucial pillar for grassroots capital mobility, cross-border commercial settlements, and individual wealth preservation in Russia. The compliance red line drawn by the Russian Central Bank means that from the second half of 2027 onwards, any peer-to-peer transfers escaping national regulatory scrutiny will lose legal standing. All conversions and transfers involving crypto assets and fiat currencies must be forcibly routed through state-authorized licensed operators, digital financial asset platforms, or controlled brokers, effectively ending the anonymous circulation of large over-the-counter funds.

Reconstructing Global Capital Pathways Under the 2027 Regulatory Tipping Point

The temporal convergence of these two policies in 2027 is no coincidence, but rather a technological projection of the synchronized maturity of global sovereign regulatory frameworks. With the full implementation of EU MiCA rules and the activation of the tax intelligence exchange mechanism under the OECD’s Crypto-Asset Reporting Framework (CARF), the two core areas traditionally difficult for regulation to reach—on-chain non-custodial holdings and over-the-counter peer-to-peer transactions—are being precisely encompassed by state apparatuses through statutory tax definitions and licensing requirements.

As exchanging for stablecoins faces direct withholding on 30% of profits, and unlicensed over-the-counter transactions yield entirely to strictly real-name intermediaries, fund holders will face a bifurcated path choice: some capital will inevitably bear institutional costs and fall completely under traditional financial scrutiny, while capital pursuing censorship resistance and autonomy may accelerate migration toward more obscure pure on-chain native protocols and decentralized non-pegged assets.

A plenary session of the French National Assembly will vote on the fiscal draft containing stablecoin tax provisions on October 20, and Russia’s Central Bank details regarding the access standards for authorized intermediaries will also be formally submitted to the State Duma for review later this year.
